Best Docs Live takes no responsibility for medical advice given. Medical advice is not meant to replace treatment and consultation with the member’s primary physician. THIS IS NOT A HEALTH INSURANCE POLICY.
Medical Information: The member is responsible for providing accurate and up-to-date medical information to Best Docs Live when calling for a physician consultation when any information changes. If a member provides any information related to AIDS or HIV, including testing for the presence of the HIV + anti-body/antigen, results of such test, and/or diagnosis of AIDS and related conditions, the member will be required to provide written authorization to release this information.
Transmission of Medical Information: A member’s information may be mailed, faxed or released over the telephone when authorized, along with any documents the member has supplied to Best Docs Live. A member’s medical information will be released only to qualified medical personnel for the purpose of the member’s care or for any other member-authorized situation.
Service Interruption: A member’s service may be interrupted if they do not remain a member in good standing. A member in good standing has: (a) verified their medical information as current, (b) paid their membership fee and not gone into arrears, (c) has not provided Best Docs Live with a written notice of cancellation. A member’s authorization to release medical information will be valid for the lifetime of their membership until they provide Best Docs Live with a notice of cancellation or until a member is no longer in good standing. A member may not hold Best Docs Live responsible for acting in reasonable reliance upon their authorization prior to the time that Best Docs Live learns of the member’s cancellation or amendment. All services are not available in all states.
General Release: You are entering into a doctor/patient relationship with Best Docs Live. You acknowledge that you already have a primary care physician and Best Docs Live is not a substitute to your primary care physician. You agree to designate Best Docs Live as your provider when your primary care physician is not available. Best Docs Live is obligated to use commercially reasonable efforts to ensure that the member’s medical information accurately reflects the information provided by the member. Best Docs Live is not responsible for, and disclaims all liability for, any and all damages arising due to any errors, inaccuracies or omissions in the application due to errors, inaccuracies, or omissions in the information provided to Best Docs Live by the member. Best Docs Live shall have no liability whatsoever for any indirect, consequential, exemplary, special, incidental or punitive damages. Best Docs Live’s liability to the member for any reason and upon any cause of action, whether tort, contract, statute or any other legal theory whatsoever, shall be at all times and in the aggregate limited to the lesser of (a) $1,000.00, or (b) the amount of compensation actually paid by the member or client to the company during the three (3) months period immediately preceding the month in which the event upon which the liability is predicated.
Confidentiality: Best Docs Live will release any and all information only as authorized for disclosure by the member and as permitted by law. Each request for information will be verified before any disclosure will be made. Best Docs Live will make every attempt to confirm that the requested information is received by the intended recipient. All memberships are maintained at the highest level of confidentiality and are never provided to other services. Use of information provided by Best Docs Live cannot guarantee that information provided to recipients will be used or acknowledge.
Recurring Billing: By starting your Best Docs Live membership and providing or designating a Payment Method, you authorize us to charge you a monthly membership fee at the then current rate, and any other charges you may incur in connection with your use of the Best Docs Live service including doctor consultations, to your Payment Method. You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to number of consults, promotional code redemptions, and/or changing or adding a plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly in one or more charges.
No Refunds: PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
Payment Methods: You may edit your Payment Method information by visiting our website and clicking on the “Your Profile” link, available at the top of the page once logged into the Best Docs Live website. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, “Cancellation” below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for details.
Cancellation: You may cancel your Best Docs Live membership at any time, and you will continue to have access to the Best Docs Live service through the end of your monthly billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNWATCHED BEST DOCS LIVE CONTENT. To cancel, go to the “My Profile and then My Payments” page on our website and simply click on the cancel account link next to your payment information. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click “View billing details” on the ” My Profile page. If you signed up for Best Docs Live using your account with a third party as a Payment Method, and wish to cancel your Best Docs Live membership at any time, you may need to do so through such third party, including by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from, the Best Docs Live service through that third party. You may also find billing information about your Best Docs Live membership by visiting your account with the applicable third party.
